1. Acceptance of Terms

By accessing or using Adhyay ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our platform. These terms apply to all users including schools, teachers, students, and parents. We reserve the right to update these terms at any time with notice provided via email or platform notification.

2. Description of Service

Adhyay is an AI-powered education platform that enables teachers and schools to generate NCERT-aligned exam papers, evaluate student answers (including handwritten sheets), track student performance, and manage academic workflows. The platform is operated by Tech Mandalae and is available at adhyay.techmandalae.com.

3. Account Registration & Responsibilities

• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized access to your account
• School administrators are responsible for managing teacher and student accounts under their institution
• Users must be at least 13 years old or have parental consent to create an account
• One person or entity may not maintain more than one free account

4. Subscription Plans & Payments

Subscription fees are billed in advance on a monthly or annual basis. All fees are in Indian Rupees (INR) and inclusive of applicable taxes. Payments are processed securely by Razorpay. We do not store payment card information.

• Free plans are available with limited features as described on our pricing page
• Paid plans unlock additional features including unlimited exam generation, AI evaluation, and analytics
• Plan features may be updated; existing subscribers will be notified of material changes
• Refunds are governed by our separate Refund Policy
• Failure to pay may result in downgrade to the free plan or account suspension

5. Acceptable Use Policy

You agree not to:

• Use the platform for any unlawful purpose or in violation of these terms
• Upload harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to the platform or other users' data
• Use automated scripts or bots to interact with the platform
• Resell or redistribute platform access without written permission
• Upload malware, viruses, or any other malicious code
• Impersonate other users, teachers, or school administrators

6. Intellectual Property

Exam papers generated using our AI remain the intellectual property of the teacher or school that generated them. Adhyay retains rights to the platform, AI models, and underlying technology. You may not reverse engineer, copy, or resell our platform or AI capabilities.

• The Adhyay name, logo, and branding are trademarks of Tech Mandalae
• Platform code, design, and functionality are proprietary to Tech Mandalae
• NCERT content used for question generation is used under fair educational use
• Users retain ownership of original content they upload to the platform

7. AI-Generated Content Disclaimer

Our AI-powered features (exam generation, answer evaluation) are powered by third-party AI (Anthropic Claude). While we strive for accuracy, AI-generated content may contain errors. Teachers and schools are responsible for reviewing AI-generated content before distribution to students. Adhyay is not liable for any errors in AI-generated exam content or evaluations.

• AI evaluations are indicative and should be reviewed by a qualified teacher before being final
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content
• Exam answers evaluated by AI may not reflect the full range of acceptable student responses

8. Student Data & COPPA Compliance

We are committed to protecting student privacy. Schools and teachers using Adhyay are responsible for obtaining appropriate consent from students and parents before entering student data into the platform, in accordance with applicable laws.

• Student data is used only for educational purposes within the platform
• We do not sell or share student data with advertisers
• School administrators may request deletion of all student data at any time
• Parents have the right to request access to or deletion of their child's data

9. Limitation of Liability

To the maximum extent permitted by applicable law, Adhyay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim. This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).

10. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice.

• You may cancel your account at any time from your profile settings
• Upon termination, your data will be retained for 30 days before deletion
• Active subscriptions will not be refunded upon voluntary termination (see Refund Policy)

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India. Consumer disputes may be referred to the appropriate consumer forum under the Consumer Protection Act, 2019. We encourage resolution of disputes through direct communication before escalating to legal proceedings.
